The conservative legal group named New Civil Liberties Alliance has taken legal action by filing a lawsuit to stop the implementation of Donald Trump's tariffs on Chinese imports. The group claims that Trump exceeded his authority by imposing these tariffs. The lawsuit was filed in a federal court in Florida and argues that Trump did not have the legal right to impose the tariffs announced on April 2, as well as the duties approved on February 1 under the International Emergency Economic Powers Act.
The NCLA alleges that Trump's actions violated the law by implementing tariffs that were not authorized, thereby encroaching on Congress’ power to regulate tariffs and disrupting the separation of powers outlined in the Constitution. The White House has not responded to requests for comment on the matter.
The lawsuit is seeking an injunction to halt the enforcement of the tariffs and reverse the changes made by Trump to the U.S. tariff schedule. Andrew Morris, senior litigation counsel for NCLA, stated that Trump abused emergency powers by imposing tariffs not authorized by the law.
No response was immediately available from the White House to comment on the lawsuit.
